By accessing or using Dermabyss ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Dermabyss is a beauty technology platform that provides:

  • AI-powered skin analysis
  • Virtual consultations with licensed beauty professionals
  • Appointment scheduling and management
  • Educational content about skincare

3. Intellectual Property Rights

All content, features, and functionality of the Service are owned by Dermabyss and protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

4. User Accounts

You must provide accurate, current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.

Account Types:

  • Consumers: Individuals seeking beauty consultations
  • Professionals: Licensed beauty professionals providing services
  • Business Owners: Spa/clinic owners managing staff

5. Medical Disclaimer

IMPORTANT

Dermabyss is NOT a medical service. Our AI analysis and professional consultations are for cosmetic and educational purposes only.

  • We do not diagnose, treat, or cure medical conditions
  • Consultations are not substitutes for medical advice
  • Always consult a licensed physician for medical concerns
  • In case of medical emergency, call 911 or seek immediate medical attention

6. Payment Terms

Prices for consultations and subscriptions are displayed in the Service and may change with notice. Payments are processed through Stripe.

Refund Policy:

  • Consultation Cancellations:
    • 6+ hours before appointment: Full refund (100%)
    • 4-6 hours before appointment: 50% refund
    • 2-4 hours before appointment: 25% refund
    • Less than 2 hours before appointment: No refund
  • No time slot selected: Full refund if cancelled before professional accepts
  • Subscriptions: Pro-rated refunds at our discretion
  • AI analysis: Non-refundable once processed
  • Refund processing: Refunds are processed within 5-10 business days

Why this policy? Professionals block time for your appointment. Late cancellations prevent them from rebooking and earning income. This policy is fair to both consumers and professionals.

7. Professional Services

Professionals on Dermabyss are independent contractors, not our employees. We are not responsible for their actions or advice. We provide the platform but do not supervise or control professional services.

8. Prohibited Uses

You may NOT use the Service to:

  • Violate any laws or regulations
  • Impersonate any person or entity
  • Harass, abuse, or harm others
  • Transmit spam or unsolicited communications
  • Interfere with the Service's operation
  • Use the Service for any illegal purpose

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DERMABYSS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or Service notification. Continued use after changes constitutes acceptance.
